Kelly Rutherford's divorce from German entrepreneur Daniel Giersch is getting nasty.
The Gossip Girl star -- who plays Blake Lively's mom -- filed court papers calling her husband of about two years violent, TMZ.com reports.

In the papers, Rutherford, 40, says she's had to call the cops twice on her estranged husband. She says Giersch, 34, allegedly cornered her during an argument. She also claims she's "intimated" by Giersch, an avid boxer and kickboxer. She alleges he threatened to take their son -- 2-year-old Hermes -- to teach her a lesson. (A judge denied her request that he not be allowed out of the country with Hermes.)

A Wednesday hearing will determine if Rutherford -- currently four months pregnant with their second child, a girl -- can bring Hermes to NYC while she films Gossip Girl.
Giersch claims Hermes becomes stressed out around Rutherford, and Rutherford is unable to mother because her shooting schedule is so intense -- claims she denies.

Giersch has also claimed his wife has a temper. "[She] has tried to hit me with an open fist when she's had an angry outburst. On July 6, she threw a laptop computer at me while we were in Hamburg. She smashed the computer on the table and it broke."
They are both seeking sole physical custody of their son with monitored visitation.
